Trip Assurance Terms & Conditions

        1. Eligibility for Participation: The Trip Assurance ("Assurance") is open to legal residents of the 50 United States and the District of Columbia, the United Kingdom, Germany, France, Italy, Spain, the Czech Republic and Poland, capable of proving residency, who are 18 years of age or older as of date of Assurance Activation (“Activation”). Assurance is governed by U.S. laws and is subject to all federal, state and local laws. Void to residents outside the above named countries, in Puerto Rico and other territories and possessions where prohibited. By registering for the Assurance, after purchase and registration of an eligible Zero Grid® product, Assurance Participants ("Participants") agree to be bound by these Terms and the decisions of Zero Grid (“Provider”), which shall be final and binding in all respects. Participants returning their Zero Grid product, and/or receiving a partial or full refund for their purchase are immediately disqualified for Assurance. 
        2. Assurance: In the event of an Eligible Loss, as deemed by the sole discretion of Provider, an eligible Participant must submit to Provider via email at info@zerogrid.com, within 24 hours of occurrence of loss, all required supporting documents (“Claim Documentation”) in order to be eligible for claim review (“Claim Review”) and/or Assurance Reimbursement (“Reimbursement”) by Provider.
        3. Assurance Period: The start and end times of the Assurance (the "Assurance Period") are limited to the lesser of the dates indicated by participant during Activation, and 14 days beginning from the first date of the activated Trip Period on the Trip Assurance Activation page. To qualify for Assurance, Participants must follow all instructions specified in the Assurance Activation page and fully complete the activation process. Participants will be required to provide certain registration information in order to register for and participate in the Assurance. All such information may be deemed acceptable at the sole discretion of the Provider. Except as otherwise specified on the Trip Assurance Activation Page, there is a limit of one (1) registration over the course of the Trip Period per person, immediate family, household, dwelling, street address, home computer, email address or account, phone line or account, DSL line or account, or cable line or account (or the equivalent of any of the foregoing). If registration has been made in violation of the terms of the previous sentence, then Provider in its sole and absolute discretion reserves the right to disqualify the Participant and any registration from any of the foregoing sources from participation in the Assurance and any and all Provider offers. Use of any method of automated submission software is prohibited. Any Participant who attempts to register with multiple e-mail addresses or under multiple identities, or uses any other device to register multiple times, except as specified in the Assurance page, will be automatically disqualified from participation. Participants who do not provide a valid email address will be disqualified. The decision of the Provider to disqualify an entry or entrant shall be final and binding in all respects.
        4. Eligible Loss: Only physical items, confirmed stolen (via Official Police report from locale where occurrence of theft took place) while being stored within an eligible Provider product (“Eligible Products”) and worn/carried by solely by Participant (in accordance with product instructions) may be deemed eligible for a Claim Review by Provider. Activation must take place prior to Participant's claimed loss. All losses claimed by Participants may be reviewed, deemed eligible or not eligible and all claims may be approved or denied at the sole discretion of the Provider.
        5. Claims: To be deemed eligible for review by the provider (“Claim Review”), any Assurance claim (“Assurance Claim”) made by a Participant must be made for an Eligible Loss occurring, with valid documentation, within the Assurance Period.
        6. Claim Documentation: Eligible Participants must provide the following required Claim Documentation within 48 hours of Eligible Loss in accordance with all other terms herein: (a) Original Proof of Zero Grid® Product Purchase, (b) Official Police Report (from local where loss took place) explicitly stating those items which were stolen, while being stored within Participant's eligible Zero Grid product. If report is in another language other than English, a certified translation of this original report must also be provided. (d) Proof of current Residency and valid mailing address. (e) Proof of purchase and evidence of U.S. dollar value for any Eligible Loss claimed.
        7. Assurance Reimbursement: In the event that an eligible Participant experiences and Eligible Loss and submits a Claim to provider with all necessary Claim Documentation within the specified timeframe, the Provider may at its sole discretion offer to provide to the Participant a reimbursement for the lesser of $300 U.S.D. (or equivalent in another currency at the sole discretion of Provider) and the documented replacement cost of Eligible Loss.
        8. Conditions of Participation & Certain Restrictions: Provider reserves the right to cancel or modify the Assurance or disqualify a Participant if fraud or technical failures destroy or undermine the integrity of the Assurance as determined by the Provider. IMPORTANT: PROVIDER RESERVES THE RIGHT TO MAKE ANY INVESTIGATION INTO THE ELIGIBILITY OF A PARTICIPANT OR REGISTRATION AND DELAY THE AWARD OF ANY ASSURANCE REIMBURSEMENT DURING THE INVESTIGATION FOR ANY PERIOD OF TIME IT DEEMS NECESSARY AND PENDING THE RECEIPT OF ANY AND ALL INFORMATION IT DEEMS NECESSARY. IF PROVIDER SUSPECTS ANY PARTICIPANT OF ATTEMPTING TO DEFRAUD OR VIOLATE THE ASSURANCE TERMS AND CONDITIONS IN ANY WAY, PROVIDER RESERVES THE RIGHT TO DISQUALIFY THAT PARTICIPANT FROM ASSURANCE AND ALL OTHER PROVIDER OFFERS. PROVIDER’S DECISIONS RESULTING FROM ANY SUCH INVESTIGATION SHALL BE FINAL AND BINDING IN ALL RESPECTS.
        9. Release of Liability: By registering for Assurance, Participants release Provider, its officers, directors, agents, contractors, employees and all entities associated with the development and execution of Assurance from any and all liability with respect to and in any way arising from Assurance Registration, Activation, submission of Assurance Claim or any use/acceptance of any applicable Assurance Reimbursement. Participants agree that Provider and its officers, directors, agents, employees and all entities associated with the development and execution of this Assurance are not responsible or liable for any injury or damage to a Participant's or third party’s computer related to or resulting from the Assurance, the registration and/or any other communications which may take place. The Provider is not liable for damage to a user’s computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to an entrant’s participation in the Assurance or downloading of information in connection with the Assurance. Provider is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, or incomplete or garbled computer transmissions that might limit a consumer's ability to participate in the Assurance.
        10. Governing Law & Dispute Resolution: All controversies regarding the Assurance shall be governed by, and construed in accordance with, the laws of the State of Arkansas, without giving effect to any choice of law rules or provisions (whether of the State of Arkansas, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Arkansas. With respect to any controversy or claim that arises regarding this Assurance and that is not resolved through negotiation, the Provider and Participant agree to seek resolution of such controversy or claim through binding arbitration in Little Rock, Arkansas, in accordance with the then current Consumer Arbitration Rules of the American Arbitration Association, and judgment on the award registered by the arbitrator may be registered in any court having jurisdiction thereof.  Any and all claims, judgments, and awards shall be limited to $300.00 U.S.D., but in no event attorney's fees; and under no circumstances will any Participant be permitted to obtain any award for, and Participant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, other than for $300.00 U.S.D., and any and all rights to have damages multiplied or otherwise increased. The costs of arbitration shall be allocated among the parties as directed by the arbitrator.

        12. PARTICIPANTS AGREE, UNDERSTAND AND ACCEPT THAT ASSURANCE IS NOT A TRAVEL INSURANCE, AND IS NOT MEANT TO REPLACE OR SUPPLEMENT TRAVEL INSURANCE. THE PROVIDER HEREIN IS NOT OFFERING OR PROVIDING AN INSURANCE PRODUCT OR POLICY OF ANY KIND AND PROVIDER NOT QUALIFIED OR LICENSED TO OFFER INSURANCE PRODUCTS OR INSURANCE ADVICE.
        13. These terms and conditions are subject to change, at any time, without prior notice to Participants.
